BREVE COMENTARIO AL TRUST ANGLOSAJÓN Y SU APLICACIÓN EN MATERIA AMBIENTAL

Samenvatting

El presente trabajo pretende hacer una somera explicación de la naturaleza, estructura y funcionamiento del Trust para aquellos que pretenden comenzar en el tema. Para tales fines, se hará un breve resumen histórico de la figura, hasta llegar a la concepción más moderna, pensando sobre todo en la lógica continental que inevitablemente se aparece cuando se trata por primera vez con elementos tan ajenos a nuestro sistema. Finalmente se realizará un análisis sobre las posibles aplicaciones del Trust en materia ambiental, las que se derivan de una concepción distinta de la propiedad respecto de ciertos bienes. 

ABSTRACT

This work aims to make a brief explanation of the nature, structure and operation of Trusts for those who want to start on the subject. For these purposes, a brief historical summary of the figure will be made, until reaching the most modern conception, thinking mostly about the continental logic that inevitably appears when we deal for the first time with elements so alien to our system. Finally, it will end with and analysis of the possible applications of the Trust in environmental matters, which are derived from a different conception of property with respect to certain assets.
