APUNTES PARA LA PARTICIPACIÓN DE NIÑOS, NIÑAS Y ADOLESCENTES EN EL PROCESO CONSTITUYENTE CHILENO

Samenvatting

El presente artículo ofrece una visión general respecto al derecho a la participación y su significado desde la perspectiva de niños, niñas y adolescentes; derecho que exige una verdadera inclusión de éstos en el proceso constituyente, a objeto de poder considerar e incorporar sus opiniones y puntos de vista. Para ello se examinan los argumentos jurídicos que sustentan el deber de nuestro país de incorporar a los niños, niñas y adolescentes en este tipo de procedimientos, se analiza el concepto ‘participación infantil’ y se esclarece la definición de ‘participación real y efectiva’. El artículo hace hincapié en los elementos básicos que debería tener este tipo de participación, así como la forma en que -a nuestro juicio- debería ser implementada. Finalmente, se hace referencia a la experiencia tanto chilena como extranjera, a objeto de otorgar una mejor comprensión respecto a cómo otros países han abordado este tema en procesos similares. 

ABSTRACT 

This work provides a comprehensive overview regarding the right to participation and its meaning, from a Children’s rights perspective. This right requires a genuine involvement of children and adolescents in the drafting of the constitution in order to inject children’s views and prospects. In doing so, it examines the legal arguments that support our country's commitment to include children in the national processes, it presents a deep insight into the general concept of child participation, and it also defines what ‘effective participation’ really means. The article highlights the core elements of significant participation, and how - in our view- it should be implemented. Finally, it delves into the Chilean experience so far, while providing a look into the international scope in order to give a better understanding of how other countries deal with effective implementation of children’s participation rights in similar proceedings.
