MUJERES HOMICIDAS EN CASOS DE VIOLENCIA DE GÉNERO

Abstract

En este trabajo se realizará un análisis dogmático de las eximentes de responsabilidad que pueden ser utilizadas en la defensa de mujeres maltratadas que, en situaciones de violencia de género, en el seno de la familia, han dado muerte a sus parejas agresoras. El artículo pretende examinar el tratamiento dogmático y jurisprudencial que se ha realizado de la legítima defensa, el miedo insuperable y el estado de necesidad en estos casos. Esto con el propósito de determinar cómo estas eximentes operan en la defensa de aquellas mujeres que, víctimas de una agresión, pasaron a ser victimarias.

ABSTRACT

This work will carry out a dogmatic analysis of the exemptions of responsibility that can be used in the defense of battered women who, in situations of gender violence within the family, have killed their abusive partners. The article aims to examine the dogmatic and jurisprudential treatment that has been made of legitimate defense, insurmountable fear and the state of necessity in these cases. This with the purpose of determining how these defenses operate in the defense of those women who, victims of aggression, became victimizers.
