LA EXPULSIÓN DE UN REFUGIADO COMO CONSECUENCIA DE LA COMISIÓN DE UN DELITO

Abstract

La presente investigación se aboca a analizar la especial situación del refugiado que se ve enfrentado a una orden de expulsión emitida por el país donde ha buscado refugio, a raíz de la comisión de un acto ilícito. En particular, se analizará la normativa interna en la materia, y su conformidad (o falta de ella) con los estándares internacionales y de derecho comparado, evaluando su aplicación práctica en nuestro país, y algunos parámetros otorgados por los tribunales de justicia en este sentido. De lo estudiado, se concluye que existen falencias tanto a nivel normativo, como en la aplicación -por parte de la autoridad administrativa- al momento de decretar estas órdenes de expulsión, lo que se contrasta con la correcta interpretación mantenida por los tribunales de justicia al momento de decidir estas situaciones. 

ABSTRACT 

This research focuses on the special situation of refugees who are faced with an expulsion order issued by the country where they have sought refuge, as a result of the commission of an illegal act. In particular, the internal regulations on the matter will be analyzed, and their compliance (or lack thereof) with international standards and comparative law, evaluating their practical application in our country, and some parameters granted by the courts in this regard. It is concluded that there are shortcomings both at the normative level, as well as in the application -by the administrative authority- when decreeing these expulsion orders, which is contrasted with the correct interpretation maintained by the court when solving these problems.
